Terms of Service

Boat Partner is a boat partnership management platform designed for yacht owners and partners in Newport Beach, California. The Service provides tools for scheduling, communication, cruise logging, maintenance tracking, photo sharing, and partnership document management among boat co-owners.

Access to the Service is provided by your boat manager or partnership administrator. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

You agree not to use the Service to:

• Harass, threaten, or intimidate other users
• Upload illegal, obscene, or harmful content
• Impersonate another person or misrepresent your identity
• Attempt to gain unauthorized access to other users' accounts or data
• Interfere with or disrupt the Service or its underlying infrastructure
• Use the Service for any purpose other than legitimate boat partnership management
• Violate any applicable local, state, national, or international law

We reserve the right to suspend or terminate your account if you violate these terms.

You retain ownership of all content you upload to the Service, including photos, videos, cruise logs, reports, forum posts, and messages ("User Content").

By uploading User Content, you grant Ebel Labs a non-exclusive, royalty-free, worldwide license to store, display, and transmit your content solely for the purpose of operating and providing the Service to you and your boat partners.

You represent that you have the right to upload any content you submit and that your content does not infringe upon the rights of any third party.

The Service, including its design, code, logos, and branding, is owned by Ebel Labs and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our prior written consent.

Boat Partner offers auto-renewable subscription plans that provide access to premium features. By subscribing, you agree to the following terms:

• Pricing: The Partner plan is available at $5.99/month (USD). Prices may vary by region and are displayed in your local currency at the time of purchase.
• Payment: Payment will be charged to your Apple ID account at confirmation of purchase.
• Auto-Renewal: Your subscription automatically renews unless it is canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same rate.
• Managing Subscriptions: You can manage and cancel your subscriptions by going to your Account Settings in the App Store after purchase.
• Free Trials: If a free trial is offered, any unused portion of the free trial period will be forfeited when you purchase a subscription.
• Refunds: Refunds are handled by Apple in accordance with Apple's refund policy. We do not process refunds directly.

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that the Service will be uninterrupted, secure, or error-free. We are not responsible for any decisions made based on information provided through the Service, including boat maintenance schedules, partner assignments, or other partnership management activities.

To the maximum extent permitted by law, Ebel Labs and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of your use of or inability to use the Service. Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you have paid us, if any, in the twelve (12) months preceding the claim.

You agree to indemnify and hold harmless Ebel Labs and its owners, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. You may request deletion of your account and personal data by contacting us.

We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by email. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Orange County, California.
